Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Entrepreneur Seramika Afbouw B.V., established in Weesp.

Consumer The natural person who does not act in the exercise of a profession or business and who enters into an agreement with Seramika Afbouw B.V.

Agreement The agreement between the entrepreneur and the consumer regarding the purchase of products via the website or other sales channels.

Products All goods offered by Seramika Afbouw B.V., including but not limited to ceramic tiles and related products.

Website The webshop of Seramika Afbouw B.V.

Article 3 – Applicability

These terms and conditions apply to every offer made by Seramika Afbouw B.V. and to every agreement concluded via the website or other sales channels.

By placing an order, the consumer declares that they agree to these terms and conditions.

Deviations from these terms are only valid if agreed upon in writing.

Article 4 – The Offer

All offers on the website are non-binding.

Seramika Afbouw B.V. takes care to ensure an accurate representation of products, prices, and specifications. Obvious errors or mistakes in the offer are not binding for the entrepreneur.

Images are for illustrative purposes only. Minor deviations in color, structure, size, or finish may occur.

Article 5 – Conclusion of the Agreement

The agreement is concluded at the moment the consumer places an order and this order has been confirmed by Seramika Afbouw B.V.

Seramika Afbouw B.V. reserves the right to refuse an order or to impose additional conditions when there are justified reasons to do so.

Article 6 – Prices

All stated prices include VAT unless stated otherwise.

Any shipping costs will be clearly displayed before the order is finalized.

Price changes resulting from changes in legislation, taxes, or duties may be passed on.

Article 7 – Payment

Payment must be made in full using the payment methods offered on the website before the order is processed.

Seramika Afbouw B.V. reserves the right to process or ship an order only after full payment has been received.

If a payment is reversed or refused, Seramika Afbouw B.V. is entitled to suspend delivery or terminate the agreement.

If a consumer fails to fulfill their payment obligation on time, they will automatically be in default after a reminder.

From that moment, statutory interest will be due and collection costs may be charged in accordance with legal regulations.

Article 8 – Delivery

Delivery takes place at the address provided by the consumer.

Delivery will take place to the point where the transport vehicle can reasonably reach.

Products are not carried inside or transported to upper floors unless agreed otherwise in advance.

If a location is difficult to access, delivery may take place at a nearby unloading point.

The consumer is responsible for providing a suitable unloading location.

Article 9 – Delivery on Pallets and Heavy Products

Many products are delivered on pallets due to their weight and fragility.

The consumer must ensure that the unloading location is accessible for freight transport and that sufficient space is available for unloading pallets.

Seramika Afbouw B.V. and the transporter are not obligated to bring goods inside or deliver them to upper floors.

Article 10 – Inspection upon Receipt and Complaints

The consumer must inspect the delivery immediately upon receipt for:

  • visible damage
  • breakage
  • incorrect delivery
  • missing products

Any damage must be reported within 48 hours after receipt.

After products have been processed or installed, complaints regarding visible defects will no longer be accepted.

Article 11 – Product Characteristics of Ceramic Tiles

Ceramic tiles may show variations in color, shade, structure, and size.

These variations are inherent to the production process and do not constitute a defect.

Variations within production tolerances do not give the right to cancel the agreement or claim compensation.

For repeat orders, products may originate from a different production batch, which may result in shade differences.

Article 12 – Calculations and Cutting Loss

Calculations or advice regarding required quantities of tiles are provided solely as a service.

No rights can be derived from such calculations.

The consumer remains responsible for determining the required quantity of materials.

We always recommend ordering additional tiles to account for cutting loss and reserves.

Article 13 – Right of Withdrawal

The consumer has the right to cancel the agreement within 14 days after receiving the product without providing a reason.

Before products are returned, the return shipment must first be registered and approved by Seramika Afbouw B.V.

Return shipments without prior notification may be refused.

Return shipping costs are borne by the consumer.

Article 14 – Conditions for Returns

If a consumer exercises the right of withdrawal, the product must be returned in a condition that allows it to be sold as new.

This means that the product:

  • must not have been used, processed, or installed
  • must not show damage or signs of use
  • must be complete, including all supplied parts
  • must be in its original packaging

The consumer must carefully package the product to prevent transport damage during return shipment.

If a product or packaging is damaged during return shipment or if the condition of the product deteriorates, Seramika Afbouw B.V. may deduct a reasonable depreciation from the refund.

Returns must be registered with Seramika Afbouw B.V. in advance. Without prior registration, a return may be refused or returned to the sender.

The costs and risks of return transport are borne by the consumer.

Article 15 – Products Excluded from Return

In some cases, returns are not possible due to the nature of the product or because the product cannot be resold.

Returns are therefore not accepted for, among others:

  • ceramic floor and wall tiles and mosaic tiles, as these products are produced in different batches where color and shade variations may occur
  • products specially ordered or produced for the consumer
  • products that are part of clearance stock, discontinued collections, or outlet sales
  • consumables such as tile adhesive, grout, sealants, and cleaning products, because it cannot be determined externally whether the products have remained free from moisture and frost
  • products that have already been installed, processed, or used
  • products that are no longer suitable for resale due to damage
  • products whose packaging is missing or damaged to the extent that safe transport or resale is no longer possible
  • gift cards or vouchers

If a product has been treated by the consumer in such a way that it can no longer be sold as new, Seramika Afbouw B.V. may decide not to accept the product as a return or apply an appropriate depreciation.

Article 16 – Samples and Settlement with Orders

Seramika Afbouw B.V. may offer the possibility to order product samples so consumers can evaluate the color, structure, and appearance of a tile.

A separate price is charged for these samples.

If a consumer places an order for the same product after receiving a sample, Seramika Afbouw B.V. may refund the cost of the relevant sample to the consumer.

This refund is offered solely as a service and cannot be regarded as a right to a discount.

The refund of sample costs will only take place under the following conditions:

  • the final order concerns the same product as the ordered sample
  • the order is placed by the same consumer who ordered the sample
  • the right of withdrawal regarding the order has fully expired
  • the order has not been returned or cancelled in whole or in part

The refund will be carried out automatically by Seramika Afbouw B.V. after the statutory withdrawal period of the order has expired. The consumer does not need to submit a request for this.

Seramika Afbouw B.V. may decide not to apply a refund of sample costs in cases of misuse, fraud, unusual quantities of sample orders, or when samples were not ordered with the intention of considering an actual purchase.

Article 17 – Warranty

Unless expressly agreed otherwise in writing, Seramika Afbouw B.V. does not provide any warranty on products that it has not manufactured itself, other than the warranty that Seramika Afbouw B.V. may have received from its suppliers.

Seramika Afbouw B.V. is not obligated to provide or perform any warranty if the buyer has not fully, correctly, or timely fulfilled their obligations toward Seramika Afbouw B.V. at the time of submitting a warranty claim.

Any form of warranty becomes void if the buyer makes or has changes or repairs made to the products themselves, if the products are used for purposes other than those for which they are intended, or if the products have been handled, used, or maintained carelessly, improperly, or incorrectly.

Article 18 – Liability

Seramika Afbouw B.V. is only liable for direct damage.

Liability is limited to the amount of the order.

Seramika Afbouw B.V. is not liable for indirect damages such as:

  • delays in construction projects
  • costs of contractors or tile installers
  • loss of income
  • additional transport costs

Article 19 – Complaints

Complaints must be reported within a reasonable period via info@seramika.nl.

Seramika Afbouw B.V. will assess complaints and seek an appropriate solution.

Article 20 – Applicable Law

All agreements are governed by Dutch law.

Disputes will be submitted to the competent court in the Netherlands.

Article 21 – Amendments

Seramika Afbouw B.V. reserves the right to amend these terms and conditions.
